LinkedIn boosts security, offering similar technology as Twitter

(Reuters) - LinkedIn Corp unveiled technology to improve the security of the social networking site for professionals, about a week after Twitter introduced similar tools following a surge in high-profile attacks on its users.

The optional service, known as two-factor authentication, is designed to verify the identity of users as they log in by requiring them to enter numeric codes sent via text message.

LinkedIn introduced the service on Friday, about a year after a highly publicized breach that exposed passwords of millions of its users. Some security experts criticized LinkedIn at the time, saying the firm had failed to use best practices to secure its passwords.

The site provided instructions to its 225 million users on how to turn on the optional service at http://linkd.in/1aIFV3D

Obama: Student loan increase like $1,000 tax hike

WASHINGTON (AP) ? President Barack Obama on Friday urged Congress to prevent student loan rates from doubling in a month, prompting a fight with House Republicans who accused him of playing politics instead of sitting down to work out small differences and avoid an increase.

Interest rates on new subsidized Stafford loans are set to go from 3.4 percent to 6.8 percent on July 1. Lawmakers from both parties say they want to avoid the increase but are divided over how to do so.

Obama said if Congress doesn't act to stop loan rates from rising, students would rack up an additional $1,000 annually in debt. "That's like a $1,000 tax hike," the president said.

Obama made his case flanked by college students wearing business suits and dresses on a steamy Washington morning in the Rose Garden. The event marked the beginning of a public campaign by the president to extend temporarily current student loan rates or find a long-term compromise to avoid the rate increase.

The event also gave the president a chance to try to move past political controversies that have been dogging his agenda, including investigations into last year's deadly attack in Libya, political targeting at the IRS and secret monitoring of journalists who reported stories based on national security leaks. Obama opened his Rose Garden appearance by touting economic improvements during his presidency.

Obama said rising college debt ? more than $26,000 on average for a four-year degree ? saddles young adults with debt just as they are starting out and prevents them from buying cars and houses, hurting the economy overall. "That doesn't just hold back our young graduates. It holds back our entire middle class," Obama said.

The White House has proposed linking federal student loan rates to the financial markets. The Republican-controlled House passed a plan last week that would reset student loan rates every year according to financial markets, but Obama has threatened to veto the bill in part because it doesn't lock in current low rates. "The House bill isn't smart and it's not fair," Obama said.

House Speaker John Boehner responded by accusing Obama of practicing "petty partisanship."

"The differences between the House plan and the president's are small, and there's no reason they cannot be overcome quickly," Boehner said in a statement. "But today, rather than working to resolve the issue, the president resorted to a campaign stunt to try to score political points. If the president is truly unhappy with inaction, the only place to look is the Democratic-run Senate, which has taken no action to prevent rates from doubling."

The Senate is scheduled to vote on the issue next week, said Majority Leader Harry Reid. The Senate version would freeze current rates for two years while Congress works on a long-term fix, something the White House says Obama supports.

Obama spoke personally about the power of an advanced degree, saying he and his wife are only in the White House because of their education. "We didn't come from privilege," the president said. He recalled they ended up paying off their student loans only in the past decade, and the payments were higher than their mortgage. "We were lucky. We had more resources than many," he said.

"Higher education cannot be a luxury for a privileged few," Obama said. "It is an economic necessity that every family should be able to afford, every young person with dreams and ambition should be able to access."

Liberty Park Opens to Public (1)The public is asked to not utilize the fishing pond at Liberty Park for the week of June 3 through June 10. This request comes from the Tennessee Wildlife Resource Agency (TWRA) as it prepares for the annual Youth Fishing Rodeo on June 8.

The Youth Fishing Rodeo is a fun experience for young novice anglers. TWRA coordinates the free event statewide to promote sports fishing in Tennessee.

Looking back?Moving Forward - Heart of the Matter

Have you ever seen a new stage in life coming straight your direction? Some days that new stage seems exciting. Other days, it looks like a freight train that is going to destroy the ?normal? that I?ve gotten so used to over the years.

For twenty years I?ve been home schooling. Twenty years. Twenty years that sometimes feel like they have gone by in a flash and at other times, they have seemed to drag on and on. And, for thirty years, I?ve been working in and around education, specifically arts education. In three years, I?ll be done home schooling and I will be facing the proverbial ?empty nest.?

Weird!

I have been reading articles and books about this new ?stage.? Some challenge me. Some inspire me. Others I vehemently disagree with and others seem to ring true with my core beliefs.

Bottom line! I?m about to become that ?older woman.?

Yes! I know that in some ways, I?m already there. I have graduated three home school grads from our own family, two are married, one is in college and we have one left in high school. I?ve assisted hundreds of other home school families in graduating their own children through our ministry with Artios Academies. But at the same time, I?ve been straddling that ?older woman? stage, because I still have one still homeschooling. But the closer he gets to graduation, the more I realize that this new ?stage? is just around the corner.

  • So, I have found myself asking questions. Questions like?
  • Is my work with education, specifically home education done when I?m done homeschooling?
  • Do I have to ?remake? myself for this new stage?as so many of the articles and books that I have read have suggested?
  • Is there room for me in home education if I?m done home schooling?
  • If there is room for me, do I have a voice?an individual voice that actually has something worthwhile to say?
  • If I DO have a voice? Is my message different now because I?m in a new stage
  • How do I make this transition gracefully?

The list of questions that I?ve been asking could go on and on.

Maybe you are facing a ?new stage? too? Sometimes just thinking about all these questions makes me paralyzed. How can I move forward without answers to all of these questions that keep racing through my mind? Can you relate?

And then, I hear God?s reply!

?You move forward just as you have in other situations. You trust me to open one door at a time. I don?t ask you to know the results. That?s MY department. I just ask you to be faithful one step at a time. Only I see the entire picture. Knowing the end from the beginning, is MY department.?

So, as I look back over thirty years of marriage, over thirty years involved in education and twenty years of homeschooling?I am clear about one thing. I?m going to embrace the fact that I?m about to be the ?older woman.? I?m going to continue to be faithful to the same message that I?ve been teaching for years. I?m going to continue to assist parents in raising students who are ?artios??fully prepared to be all that God has called them to be. That means talking about the ?heart of the matter??which is reaching the hearts of our children.

Looking back?It?s a mission that God called John and I to when we began our own personal homeschooling journey.

Looking forward?It?s a mission that I know God has called us to in the future. A mission that is now enriched by the fact that we can look back and glean from our years of experience?the mistakes and the successes.
The results of our efforts?.well, that?s God?s department!

Why Fact-Checkers Find More GOP Lies

PolitiFact rated Republican claims to be "false" or "pants on fire" three times more often than it rated Democratic claims that way this year, according to a new study by the Center for Media and Public Affairs at George Mason University. So: Does the GOP lie more? Is PolitiFact biased??Or do GOP liars ? like fact-checking "dream" Michele Bachmann ? get more attention?

The Pulitzer prize-winning?PolitiFact is run by the?Tampa Bay Times, and its reporters and editors sort politicians' claims into one of six categories: true, mostly true, half true, mostly false, false, and pants on fire ? the last having an element of the "ridiculous." You can see how those ratings break down for both parties in the pie charts at right. A majority of Democratic claims were rated true; a majority of Republican claims were rated false. CMPA points out that PolitiFact found more Republican lies even in May ? though there are three agency scandals facing the Obama administration: over the IRS targeting conservative groups, over the State Department's talking points about Benghazi, and over the Justice Department's investigation into leakers. This month, 60 percent of Republican claims have been rated as lies, while 29 percent of Democratic claims have been.

Why is that? It's possible the fact-checkers are intentionally or unintentionally letting some bias show through. Whether or not that's true, the state of each party right now most certainly plays a role. A lot of very conservative Republicans got elected in 2010, and the Tea Party got a lot of attention, and some Tea Party Republicans have had a tendency to say inflammatory things. Like, say, Michele Bachmann.

Rival fact-checker Glenn Kessler of The Washington Post noted on Tuesday that with Bachmann's retirement, he'll lose some of his best material: "As one of our colleagues put it, 'The entire fact checking industry may have to hold a national day of mourning.'"?In 2013 Bachmann has earned four Pinocchios, the most false rating the Post offers. Over her career, PolitiFact rated 15 Bachmann claims to be "pants on fire" ratings, its harshest rating. PolitiFact called her retirement "shocking."?

Bachmann was a fact-checker's dream because she was prominent, she got lots of attention, and she didn't mind throwing out easily disprovable statistics. But she's only a four-term member of Congress from Minnesota, and she doesn't have an important leadership role in the House. Nevertheless, she was elevated to national stardom by the cable news appearances that offered fact-checkers so much great material. And that helped her launch a presidential campaign.

Democratic Rep. Yvette Clarke was elected the same year as Bachmann, 2006. But PolitiFact didn't bother with Clarke when she went on?The Colbert Report in September 2012 and said that Brooklyn still had slavery in 1898, five decades after New York abolished slavery, and three decades after the Civil War ended. "Slavery. Really? I didn?t realize there was slavery in Brooklyn in 1898," Colbert responded. "I'm pretty sure there was," Clarke said.

PolitiFact did not rate this claim. There are some obvious reasons why ? Clarke is a little-known congresswoman; her claim was not about a current policy debate. Bachmann, on the other hand, was a presidential candidate.

McCain visits rebels in Syria

WASHINGTON (AP) ? Leaders of Syria's opposition forces got a chance to make their case for increased U.S. support directly with Sen. John McCain when he slipped into that country for a surprise visit.

McCain, R-Ariz., favors providing arms to rebel forces in Syria.

A State Department official said the department was aware of McCain crossing into Syrian territory Monday, but referred further questions to McCain's office. McCain spokeswoman Rachel Dean confirmed the Monday trip, but declined further comment.

The visit took place at the same time as meetings in Paris involving efforts to secure participation of Syria's fractured opposition in an international peace conference in Geneva.

And in Brussels, the European Union decided late Monday to lift the arms embargo on the Syrian opposition while maintaining all other sanctions against President Bashar Assad's regime after June 1, British Foreign Secretary William Hague said.

Two years of violence in Syria have killed more than 70,000 people, according to the United Nations. President Barack Obama has demanded that Assad leave power, while Russia has stood by Syria, its closest ally in the Arab world.

McCain has been a fierce critic of Obama administration policy there while stopping short of backing U.S. ground troops in Syria, but he supports aggressive military steps against the Assad regime.

Gen. Salem Idris, chief of the Supreme Military Council of the Free Syrian Army, accompanied McCain across the Turkey-Syria border. McCain met with leaders of the Free Syrian Army from across the country, who asked him for increased U.S. support, including heavy weapons, a no-fly zone, and airstrikes on Syrian government and Hezbollah forces, according to The Daily Beast, which first reported the senator's visit.

Such unannounced trips to world hotspots by U.S. politicians are not common.

The White House declined to comment late Monday.

Last week, the Senate Foreign Relations Committee voted to provide weapons to rebels in Syria, as well as military training to vetted rebel groups and sanctions against anyone who sells oil or transfers arms to the Assad regime. McCain is a member of the committee.

Buffett picks up Las Vegas-based NV Energy for $5.6 billion

(Reuters) - Berkshire Hathaway Inc's power production unit MidAmerican Energy will pay $5.6 billion for NV Energy Inc , the electric utility that serves Las Vegas and its power-hungry casinos.

MidAmerican Energy Holdings Co will purchase NV Energy's common stock for $23.75 per share, a 23 percent premium to NV's Wednesday closing price.

"This is a great fit for Berkshire Hathaway, and we are pleased to make a long-term investment in Nevada's economy," Berkshire Hathaway Chairman Warren Buffett said in a statement.

Las Vegas-based NV Energy, which serves about 2.4 million people in Nevada, said last month it would accelerate the retirement of its coal-fired power generating facilities and the construction of natural gas and renewable power plants.

"By joining forces with MidAmerican, we will gain access to additional operational and financial resources," NV Energy Chief Executive Michael Yackira said.

Once the deal is complete, MidAmerican Energy will have assets of about $66 billion and its regulated electric and gas utilities will serve 8.4 million customers.

Remember Me Hands On With The Custom Combo Creator

Remember Me is an upcoming Capcom release that will combine platforming, exploration, stealth, plus lots of punching and kicking. Sounds like countless other games out there, right? Right.

?

But it?s all in the details, as the saying goes. And it would appear that the first game to hail from Paris based Dontnod Entertainment, a new studio formed by individuals who worked on Rainbow 6, Splinter Cell, and Heavy Rain, is culmination of those aforementioned titles, of all the lessons learned, with a heavy sci-fi sheen laid on top.

?

What?s Remember Me all about? Well,it is the year 2084 (one hundred years removed from 1984, which is no coincidence, I was told by a Capcom rep) and memories appears to be as precious as gold, perhaps more so. So much so that there are individuals who are dedicated to the art of stealing and altering memories.

?

Remember Me Hands On With The Custom Combo Creator?

You play as one such person, Nilin, a former agent employed by MEMORIZE, the Big Brother of Remember Me. The demo I was able to test drive kicked off not long after the game?s beginning, where she awakens in the slums of Paris, where memories junkies fight over scraps of pleasant thoughts (I think).

?

Nilin, quite appropriately enough, has had her memory wiped out, but thankfully you have some mysterious fellow passing along instructions, to help get one started. After learning the basics of combat, the demo required me to follow one of the underground denizens across town.

?

On a purely surface level, Remember Me was visually pleasing, despite the fact that the parts I traversed were designed to be ugly. Its rendition of Paris was that of a city that was once the cradle of art and culture, now ravaged by technology and politics. One that was also quite dark and confusing, hence they liberal use directions to help Nilin on the right track. It?s clear that Dontnod Entertainment loves type, with the aforementioned instructions presented in big and bold blocks of text, bathed in white and orange. Remember Me is quite future stylish, albeit not in the most original of ways.

?

Though dark corners and sans-serif fonts aside, the heart of the game is running around and climbing, which feels a lot like Uncharted, as well as melee combat, which is reminiscent of quite a few other games on the market today, pretty much insert any name you can think of here, except with one significant twist: customization. This is achieved via the Combo Lab.

?

Remember Me Hands On With The Custom Combo Creator?

Like many similar games, you learn new moves as you play, but Remember Me allows you to create you own combos, called Pressens, by collecting the building blocks, called Procedural Mastering Power. The basic concept is that Nilin already knows these moves, and you?re simply unlocking them as you go along. Makes sense. There are different types of Pressens, and the most intriguing thing is how the elements can be combined. For example, a Power Pressen is a combo that combines various different movies and ends with a flashy finish. You also have a Regen Pressen, which doesn?t do much damage, but have regenerative qualities, if completed successfully.

?

With some tinkering around in the Combo Lab, I was able to create a string that both dished a significant amount of damage and also gave myself a little health. Though, not surprisingly, the button combination that brings everything together was hard to pull off; the combat is heavily reliant upon timing and not just pure button mashing. I was only able to pull of this super mega awesome combo 2 out of the 10 times.

?

The idea of a completely customized combo sounds great, and it?s even better once one has been finally crafted. But the middle part is where I had problems with Remember Me. It?s a bit ironic how a game that places such importance on customization plus sexy, clear graphic design, is not able to get the two ideals talking.

?

The Combo Lab was somewhat of a chore to create combos, and I needed to be walked through the process quite heavily by the rep. There is a genuine fear that many casual players will become frustrated by the process of creating something truly unique and simply follow the onscreen prompts to create something basic. Then again, perhaps hardcore players will have no problem in the end, and maybe regular folk as well, after enough time has been spent learning the nuances of the interface. Admittedly, my time with Remember Me was quite fleeting.

?

Remember Me comes out soon, very soon. June 4 in North America to be exact.

Police are investigating the death of a 42-year-old man who was shot in the head early Sunday. The county medical examiner says Charles Jones was pronounced dead at around 3:30 a.m. The?shooting?stemmed from a crash and a woman was taken to the hospital.

Also killed Sunday was a man in his late 20s who was shot in the armpit and pronounced dead at a suburban hospital.

Two people were killed in?shootings?Saturday, including 18-year-old Fearro Denard and a 29-year-old man who was shot not far from President Barack Obama's South Side home.

On Friday, a 17-year-old and 22-year old were killed in separate?shootings.

(AP) ? Americans gathered at memorials, museums and monuments and the president laid a wreath at Arlington National Cemetery to honor fallen service members on Memorial Day, as combat in Afghanistan approaches 12 years and the ranks of World War II veterans dwindle.

"Let us not forget as we gather here today that our nation is still at war," President Barack Obama said after laying a wreath at the Tomb of the Unknowns.

"When they give their lives, they are still being laid to rest in cemeteries in quiet corners across our country, including here in Arlington," he said. He told the stories of three soldiers who had died. Each had been devoted to their mission and were praised by others for saving lives.

Hours later, veterans from conflicts from World War II to Afghanistan and Iraq gathered in Atlanta to dedicate a new veterans' park. Soldiers, airmen, Marines and seamen looked on as veterans and military family members sprinkled soil, sand and water from battlefields and waterways across the world.

Retired Army Lt. Col. Rick Lester called it "a reminder of our country's timeline of freedom." A 26-year veteran with multiple tours in Vietnam, Germany and Korea, Lester conceived the ceremony as a way to honor living veterans and those who never made it home.

The pilot recalled in detail the numbers of men lost on missions he flew in Vietnam. "All I can think about is how those were some of the greatest guys I ever met and what they would have done for this country once they got back," he said.

The soil and sand ranged from Revolutionary battlefields like Lexington and Concord to Tikrit in Iraq. There was none from the Civil War, Lester said, because "that was a time that our country was divided."

Battlefield remnants were mixed in a helmet Lester's father wore on D-Day in France in 1944. They were sprinkled from cups that his uncle, a Marine, used in World War II. His father lived. His uncle was killed in action.

Susan Jimison poured water collected from the Hudson River, Chesapeake Bay, Atlantic Ocean and Pacific Ocean.

Her brother, Mark Clotfelter, was a helicopter pilot shot down June 16, 1969, in Vietnam. The 22-year-old was later confirmed dead. Jimison was 14 at the time and recalled how a politically unpopular war affected the way her brother's death was treated. "Nobody talked about it," she said.

It wasn't until many years later that she started trying to learn about his military service and those who served alongside him. Now, she's married to a man, Michael Jimison, who flew with him, and she's writing a book about their company.

It's important, she said, for Americans to learn the personal stories behind military history and international conflict. "My brother died doing what he loved doing," she said.

New York Mayor Michael Bloomberg joined military leaders and others at the Soldiers' and Sailors' Monument in Manhattan. He later encouraged New Yorkers to celebrate the day and the good weather but also "remember the sacrifice that was made so that we could be here."

At the National World War II Museum in New Orleans, about 20 bicyclists clustered around veteran and museum volunteer Tom Blakey. The paratrooper in the 82nd Airborne Division jumped at Normandy on D-Day ? June 6, 1944 ? and in May 1945 helped liberate the work camp at Wobbelin in northwest Germany.

"Most of us wondered why we were there, killing people and being killed," he said. "We didn't do anything to deserve it. When we got to that camp and saw what was there, the lights came on."

The cycling group makes regular weekend training runs, and on Monday started a Memorial Day ride about seven miles away at the national cemetery in Chalmette, where the Battle of New Orleans ? the last in the War of 1812 ? was fought.

Once again aboard the historic USS Hornet, 83-year-old Dale Berven reflected on his tour of duty in Korea as a naval aviator as he took in the commemoration. As the bugle corps warmed up, Berven looked out from the now-decommissioned aircraft carrier docked in Alameda, across the bay from San Francisco, which ferried him around the world in a goodwill tour in 1954, the year after the Korean War ended.

At just 23 years old, Berven said he flew dozens of sorties as a lieutenant junior grade with the 91st Fighter Squadron.

"I was young and single, I had volunteered and I wanted to do that type of work," said Berven, now a docent at the USS Hornet Museum. "That is how people are now. They're not drafted, so you have 18-, 19-year olds who are giving up their lives for the freedom of this country. We ought to honor all those service men and women and not bring politics into it."

In South Sioux City, Neb., a statue honoring a Navy dog handler was unveiled in his hometown. The statue of Petty Officer 1st Class John Douangdara (dwung-DEHR'-ah) and his dog, Bart, is part of a five-acre dog park that's named for Douangdara. Douangdara died along with 29 other Americans in August 2011 when a military helicopter was shot down in Afghanistan.

Across much of New England, several days of heavy rain gave way to sunny skies for parades in towns large and small.

In Portland, Maine, kids and even pets displayed the Stars and Stripes as veterans, youth groups law enforcement officials and civic organizations paraded to Monument Square to the tunes of a marching band, sirens from a police car and the rumble of motorcycles.

For some veterans, it was a somber event.

Richard Traiser, a Marine injured when his tank came under attack in Vietnam, helped deliver a three-volley salute with the Marine Corps League.

Memorial Day gives those who served an opportunity to get together and remember friends who didn't make it.

"I think about them a lot, especially the people I lost in my platoon," Traiser said. "I don't dwell on it in a morbid way, but it's on your mind."

In Connecticut, a Waterford man who was killed in the Vietnam War was honored with a hometown park area named for him. Arnold E. Holm Jr., nicknamed "Dusty," was killed when his helicopter was shot down on June 11, 1972.

The holiday weekend also marked the traditional start of the U.S. vacation season. AAA, one of the nation's largest leisure travel agencies, expected 31.2 million Americans to hit the road over the weekend, virtually the same number as last year. Gas prices were about the same as last year, up 1 cent to a national average of $3.65 a gallon Friday.

At the American Airpower Museum on Long Island, N.Y., a program honored Women Air Service Pilots, or WASPs, who tested and ferried completed aircraft from factories to bases during World War II. Thirty-eight died during the war, including Alice Lovejoy of Scarsdale, N.Y., who was killed on Sept. 13, 1944, in a midair collision over Texas.

Women have made their way up the ranks in the regular military since then, exhibited in Wisconsin, with retired Air Force Maj. Gwen Sheppard becoming the first woman to serve as the grand marshal of the Milwaukee Memorial Day parade.

"It's very important that we recognize not only their contribution to American history, but women's history," said Julia Lauria-Blum, curator of the WASP exhibit at the museum. "These women really blazed a path. And most important, they gave their lives serving their country and must be honored like anyone else on Memorial Day."

IMF Rethinks Sovereign Defaults, Again ? naked capitalism

I noted back in January that the IMF had started to do its own ?lessons learned? on its European financial crisis response and had begun to admit it had made some fairly terrible mistakes in its assessment of the debt sustainability of a number of nations, including Greece, under its current programs.

Late last week the IMF released another discussion paper (available below) that covers recent developments in sovereign debt restructures and their effect on IMF policy. The paper concludes that:

First, debt restructurings have often been too little and too late, thus failing to re-establish debt sustainability and market access in a durable way. Overcoming these problems likely requires action on several fronts, including

(i) increased rigor and transparency of debt sustainability and market access assessments,
(ii) exploring ways to prevent the use of Fund resources to simply bail out private creditors, and
(iii) measures to alleviate the costs associated with restructurings

Second, while creditor participation has been adequate in recent restructurings, the current contractual, market-based approach to debt restructuring is becoming less potent in overcoming collective action problems, especially in pre-default cases. In response, consideration could be given to making the contractual framework more effective, including through the introduction of more robust aggregation clauses into international sovereign bonds bearing in mind the inter-creditor equity issues that such an approach may raise. The Fund may also consider ways to condition use of its financing more tightly to the resolution of collective action problems;

Third, the growing role and changing composition of official lending call for a clearer framework for official sector involvement, especially with regard to non-Paris Club creditors, for which the modality for securing program financing commitments could be tightened; and

Fourth, although the collaborative, good-faith approach to resolving external private arrears embedded in the lending into arrears (LIA) policy remains the most promising way to regain market access post-default, a review of the effectiveness of the LIA policy is in order in light of recent experience and the increased complexity of the creditor base. Consideration could also be given to extending the LIA policy to official arrears.

In short, the assessments of debt sustainability have been woeful, there aren?t strong enough binding terms (read CACS) in sovereign securities, the official sector, but not the IMF itself, need to play a part in defaults and the IMF should investigate the optimal debt resolution mechanisms available for negotiating between creditors and debtors.

The paper discusses the implication of the ongoing litigation against Argentina as well as the experience of the fund in the recent case of Greece. Of note is the admission by the fund that it was forced to lower its assessment of the country due to contagion worries from the official sector in Europe:

Accordingly, when a member?s sovereign debt is unsustainable and there are concerns regarding the contagion effects of a restructuring, providing large-scale financing without debt relief would only postpone the need to address the debt problem.

Instead, the appropriate response would be to deal with the contagion effects of restructuring head-on by, for example, requiring that currency union authorities establish adequate safeguards promptly and decisively to cushion the effect of spillovers to other countries (via, e.g., proactive recapitalization of creditor banks, establishment of firewalls, and provision of liquidity support). In the context of the first Greece program, financial assistance was delayed until Greece had lost market access. In response to concerns about possible spillovers from debt restructuring, the Fund lowered the bar for exceptional access (second criterion) by creating an exception to the requirement for achieving debt sustainability with a high probability in the presence of systemic inter national spillover effects. In light of these issues, the modification of the exceptional access policy could usefully be reviewed

In other words, Europe, and its banks, weren?t prepared for a Greek default so the IMF was forced to pretend that the country?s position was better than it actually was. That was obviously a mistake and the country, like many before it, was forced to take a second bailout followed by a re-structure that should have occurred up front. As noted by the paper:

A review of the recent experience suggests that unsustainable debt situations often fester before they are resolved and, when restructurings do occur, they do not always restore sustainability and market access in a durable manner, leading to repeated restructurings. While the costs of delaying a restructuring are well recognized, pressures to delay can still arise due to the authorities? concerns about financial stability and contagion. Delays were also sometimes facilitated by parallel incentives on the part of official creditors, who accordingly may have an interest in accepting, and pressuring the Fund to accept, sanguine assessments of debt sustainability and market reaccess.

And:

In hindsight, the Fund?s assessments of debt sustainability and market access may sometimes have been too sanguine.

The existing DSA framework does not specify the period over which debt sustainability or market access is supposed to be achieved (although it is generally understood that debt would be sustainable within a five-year horizon) or how maximum sustainable debt ranges should be derived, leaving this mostly to Fund staff judgment. Sustainability was generally assessed on the basis of an eventual decline in the debt-to-GDP ratio?Argentina, Seychelles and St. Kitts and Nevis were the only three cases that provided for a quick and sizable reduction in the debt-to-GDP levels post-restructuring. St. Kitts and Nevis also targeted an explicit debt threshold, i.e., the ECCU debt target of 60 percent of GDP by 2020. Most other cases allowed more than five years for the debt level to fall significantly below safe levels.

For example, in Greece the debt-to-GDP ratio in the most recent program projections is not expected to be reduced substantially below 110 percent before 2022, while in the forthcoming Fund-supported program with Jamaica, debt is still projected to remain close to 120 percent of GDP in five years? time. In Grenada, the debt ratio at the end of the five-year horizon actually turned out much higher than staff projections at the time of the restructuring. Also, in Greece, Jamaica (2010) and Seychelles, staff medium-term debt projections have been revised upward substantially within only a few years compared to projections made at the time of the restructurings.

Also of note is the emphasis on the broader guidelines of the IMF programs , supporting countries sustainable return to private capital markets in a specific time-frame , and what that means in terms of the types of restructures that should be used and how, and when, the IMF can support them:

There may be a case for exploring additional ways to limit the risk that Fund resources will simply be used to bail out private creditors.

For example, a presumption could be established that some form of a creditor bail-in measure would be implemented as a condition for Fund lending in cases where, although no clear-cut determination has been made that the debt is unsustainable, the member has lost market access and prospects for regaining market access are uncertain.

In such cases, the primary objective of creditor bail-in would be designed to ensure that creditors would not exit during the period while the Fund is providing financial assistance. This would also give more time for the Fund to determine whether the problem is one of liquidity or solvency. Accordingly, the measures would typically involve a rescheduling of debt, rather than the type of debt stock reduction that is normally required in circumstances where the debt is judged to be unsustainable.

Providing the member with a more comfortable debt profile would also have the additional benefit of enhancing market confidence in the feasibility of the member?s adjustment efforts, thereby reducing the risk that the debt will, in fact, become unsustainable. While bail-in measures would be voluntary (ranging from rescheduling of loans to bond exchanges that result in long maturities), creditors would understand that the success of such measures would be a condition for continued Fund support for the adjustment measures. Such a strategy?debt rescheduling instead of debt reduction?would not be appropriate when it is clear that the problem is one of solvency in which case reducing debt upfront to address debt overhang and restore sustainability would be the preferred course of action.

In light of the ongoing litigation against Argentina the paper also appears to be pushing for two things, firstly the introduction of a standard across-the-board mechanism to support collective action clauses, and resolution, within the sovereign debt markets:

Recent experience indicates that the contractual, market-based approach has worked reasonably well in securing creditor participation and avoiding protracted negotiations. But these episodes have also foreshadowed potential collective action problems that could hamper future restructurings. These problems are most acute when a default has not yet occurred, large haircuts are needed to reestablish sustainability, and sovereign bond contracts do not include CACs. The ongoing Argentina litigation has exacerbated the collective action problem, by increasing leverage of holdout creditors. Assuming there continues to be lack of sufficient support within the membership for the type of statutory framework envisaged under the SDRM, avenues could be considered to strengthen the existing contractual framework.

These aspects of the Greek legislation resemble the aggregation features of the SDRM. The key differences between the framework envisaged under the SDRM and the Greek legislation is that the SDRM would be established through a universal treaty (rather than through domestic law),
apply to all debt instruments (and not just to bonds governed by domestic law), and be subject to the jurisdiction of an international forum (rather than the domestic courts of the member whose debt is being restructured). At this stage, there does not appear to be sufficient support within the membership to amend the Articles of Agreement to establish such a universal treaty.

Complementing efforts to revamp CACs, the Fund may consider conditioning the availability of its financing more tightly to the resolution of collective action problems.

For instance, the use of high minimum participation thresholds could be required in debt exchange operations launched under Fund-supported programs to ensure broad creditor participation. Fund policy encourages members to avoid default to the extent possible, even after restructuring. An expectation of eventually being paid out in full may encourage holdouts. The use of high minimum participation thresholds would help reduce such incentives. The Fund could also routinely issue statements alerting creditors that securing a critical participation mass in the debt exchange would be required for the restoration of external stability?the implication being that failure to meet the
established minimum participation threshold would block future program financing, leaving no other option but default and protracted arrears.

Also, in pre-default restructurings, where collective action problems are most acute, the Fund could consider setting a clearer expectation (already allowed under existing policy) that non-negotiated offers by the debtor?following informal consultations with creditors?rather than negotiated deals, would be the norm, as in these cases speed is of the essence to avoid a default. These ideas could be explored in future staff work.

And the second area, that is also ?to be explored in future staff work?, is what to do about the risks caused by asymmetry in the treatment of private and official sector creditors, something that was very apparent in the recent Greek restructure:

? arrears to private and official creditors are currently treated asymmetrically under Fund policy.

Private external arrears are tolerated but arrears to official bilateral lenders are not. This subjects the Fund to the risk that it could not assist a member in need due to one or more holdout official bilateral creditors who seek favorable treatment of their claims. Consideration could be given to extend the LIA policy to official bilateral arrears and in that context clarify the modality through which assurances of debt relief are provided by (non-Paris Club) official lenders. Another possibility would be for the Paris Club to extend its membership to all major lenders, so as to allow the Fund to rely on the Paris Club conventions with respect to financing assurances and arrears.

However, it is uncertain whether the Club could achieve such an expansion.

All up it?s an interesting paper and well worth the read if you are interested in this type of thing. The paper also has some discussion on the European crisis-resolution mechanism ( discussed in more detail here ) , although given recent back-steps from Europe on the banking union this looks to still be something of a distant dream at this point.

It will be interesting to see if this paper has any effect on future programs, but it does appear, if only very slowly, that the IMF is learning from past mistakes and attempting to shift policy in a direction to address that issue. It would appear, at least from this paper, that the IMF will be demanding a more realistic assessment of the debt sustainability of target nations and a greater use of up-front restructuring as a per-requisite for program engagement. We?ll have to watch the next steps in Europe to determine if this is simply a talking point or something the IMF board will action.

Russia 8.2 earthquake is big but no deaths

Russia 8.2 earthquake: The USGS says it was even bigger, an 8.3 earthquake, and felt as far away as Moscow. But the Russia earthquake caused no fatalities.

Far eastern Russia experienced a magnitude 8.3 earthquake, according to the USGS. Russian officials reported an 8.2 quake.

A magnitude 8.2 earthquake struck off Russia's eastern coast on Friday, briefly prompting a tsunami scare but causing no casualties or substantial damage, Russian emergency authorities said.

The USGS says the quake was actually magnitude 8.3.

The epicentre of the quake was located at a depth of 385 miles (620 km) in the Sea of Okhotsk, 244 miles (390 km) west of the nearest city, Petropavlovsk-Kamchatsky, the U.S. Geological Survey said.

How big is a magnitude 8.2 quake, compared to say, a magnitude 5.8 quake?

The magnitude scale is really comparing amplitudes of waves on a seismogram, not the strength (energy) of the quakes. So, a magnitude 8.2 is 251 times bigger than a 5.8 quake as measured on seismograms, but the 8.2 quake is about 3,981 times stronger than the 5.8, according to the US Geological Survey.

The USGS says:

This quake was felt in Petropavlovsk-Kamchatsky, the main city on the Kamchatka peninsula and home to a nuclear submarine base, and on Sakhalin island, where Russia's largest liquefied natural gas project is located.

Regional emergency authorities issued a tsunami warning for Sakhalin and the Kurile islands, advising residents of dangerous areas to seek high ground, but lifted the warning several minutes later.

Residents of northern Japan felt the quake but there was no tsunami warning from Japan's meteorological agency. (Editing by Elizabeth Piper)

Judge: Ariz. sheriff's office profiles Latinos

PHOENIX (AP) ? A federal judge has ruled that the office of America's self-proclaimed toughest sheriff systematically singled out Latinos in its trademark immigration patrols, marking the first finding by a court that the agency racially profiles people.

The decision by U.S. District Judge Murray Snow in Phoenix backs up years of allegations from Maricopa County Sheriff Joe Arpaio's critics who say his officers violate the constitutional rights of Latinos in relying on race in their immigration enforcement.

Snow, whose ruling Friday came more than eight months after a seven-day, non-jury trial, also ruled Arpaio's deputies unreasonably prolonged the detentions of people who were pulled over.

The ruling marks a thorough repudiation of the immigration patrols that made Arpaio a national political figure, and it represents a victory for those who pushed the lawsuit.

"For too long the sheriff has been victimizing the people he's meant to serve with his discriminatory policy," said Cecillia D. Wang, director of the ACLU Immigrants' Right Project. "Today we're seeing justice for everyone in the county."

Monetary damages weren't sought in the lawsuit but rather a declaration that Arpaio's office engages in racial profiling and an order that requires it to make policy changes.

Stanley Young, the lead lawyer who argued the case against Arpaio, said Snow set a hearing for June 14 where he will hear from the two sides on how to make sure the orders in the ruling are carried out.

The sheriff, who has repeatedly denied the allegations, won't face jail time as a result of Friday's ruling.

Tim Casey, Arapio's lead attorney in the case, said an appeal was planned in the next 30 days.

"In the meantime, we will meet with the court and comply with the letter and spirit of the order," he said.

A small group of Latinos alleged in their lawsuit that Arpaio's deputies pulled over some vehicles only to make immigration status checks. The group asked Snow to issue injunctions barring the sheriff's office from discriminatory policing and the judge ruled that more remedies could be ordered in the future.

The group also accused the sheriff of ordering some immigration patrols not based on reports of crime but rather on letters and emails from Arizonans who complained about people with dark skin congregating in an area or speaking Spanish. The group's attorneys noted Arpaio sent thank-you notes to some who wrote the complaints.

The sheriff said his deputies only stop people when they think a crime has been committed and that he wasn't the person who picked the location of the patrols. His lawyers said there was nothing wrong with the thank-you notes.

Young, the group's lawyer, said he was still reading the decision Friday but noted it contained "very detailed findings of discriminatory intent and effect."

Casey said that MCSO's position "is that it has never used race and will never use race in its law-enforcement decisions." He added the sheriff's office relied on "bad training" from the U.S. Immigration and Customs Enforcement.

A call to ICE officials in Phoenix for comment wasn't immediately returned Friday evening.

Arpaio, who turns 81 next month, was elected in November to his sixth consecutive term as sheriff in Arizona's most populous county.

Known for jailing inmates in tents and making prisoners wear pink underwear, Arpaio started doing immigration enforcement in 2006 amid Arizona voter frustration with the state's role as the nation's busiest illegal entryway.

Snow wrote that "in the absence of further facts that would give rise to reasonable suspicion or probable cause that a violation of either federal criminal law or applicable state law is occurring," Arpaio's office now is enjoined from enforcing its policy "on checking the immigration status of people detained without state charges, using Hispanic ancestry or race as any factor in making law enforcement decisions pertaining to whether a person is authorized to be in the country, and unconstitutionally lengthening stops."

Snow added "the evidence introduced at trial establishes that, in the past, the MCSO has aggressively protected its right to engage in immigration and immigration-related enforcement operations even when it had no accurate legal basis for doing so."

The trial that ended Aug. 2 focused on Latinos who were stopped during both routine traffic patrols and special immigration patrols known as "sweeps."

During the sweeps, deputies flood an area of a city ? in some cases, heavily Latino areas ? over several days to seek out traffic violators and arrest other offenders. Immigrants who were in the country illegally accounted for 57 percent of the 1,500 people arrested in the 20 sweeps conducted by his office since January 2008, according to figures provided by Arpaio's office.

At trial, plaintiffs' lawyers drew testimony from witnesses who broke down in tears as they described encounters with authorities, saying they were pulled over because they were Hispanic and officers wanted to check their immigration status, not because they had committed an infraction. The sheriff's attorneys disputed such characterizations, typically working to show that officers had probable cause to stop the drivers based on a traffic violation.

Plaintiffs' lawyers also presented statistics to show Latinos are more likely to be stopped on days of immigration patrols and showed emails containing offensive jokes about people of Mexican heritage that were circulated among sheriff's department employees, including a supervisor in Arpaio's immigrant smuggling squad.

Defense lawyers disputed the statistical findings and said officers who circulated offensive jokes were disciplined. They also denied the complaint letters prompted patrols with a discriminatory motive.

The ruling used Arpaio's own words in interviews, news conferences and press releases against him as he trumpeted his efforts in cracking down on immigrants. When it came to making traffic stops, Arpaio said in 2007 that deputies are not bound by state laws in finding a reason to stop immigrants.

"Ours is an operation, whether it's the state law or the federal, to go after illegals, not the crime first, that they happen to be illegals," the ruling quoted Arpaio as saying. "My program, my philosophy is a pure program. You go after illegals. I'm not afraid to say that. And you go after them and you lock them up."

Some immigrant traffic stops were made "purely on the observation of the undercover officers that the vehicles had picked up Hispanic day laborers from sites where Latino day laborers were known to gather," the ruling said.

The judge also said the sheriff's office declared on many occasions that racial profiling is strictly prohibited and not tolerated, while witnesses said it was appropriate to consider race as a factor in rounding up immigrants.

"This is a blow to" the sheriff's office, said David A. Harris, a law professor at the University of Pittsburgh who studied racial profiling and wrote a book on the subject.

Arpaio's lawyers will have "an uphill climb" in the appeals process because of all "the gross statistical evidence," he said.

China says hopes visit of North Korean envoy can ease tension

BEIJING (Reuters) - China hopes that this week's visit by a senior North Korean envoy can ease tension in the region and help spur efforts to rid the Korean peninsula of nuclear weapons, a Chinese Foreign Ministry spokesman said on Friday.

Choe Ryong-hae, a special envoy of North Korean leader Kim Jong-un, met Chinese officials in the highest-ranking visit by an official from Pyongyang in about six months.

"We hope that this visit can ameliorate the present tension on the Korean peninsula and give new impetus to pushing for the denuclearization of the peninsula," ministry spokesman Hong Lei said at a daily briefing.

On Friday, Choe met General Fan Chonglong, vice chairman of China's powerful Central Military Commission, who warned Choe about tension on the peninsula threatening peace.

"In recent years, the state of affairs around the Korean peninsula nuclear issue frequently turns into one escalation of tensions after another," China's Xinhua state news agency cited Fan as saying.

"The conflicting strategies of all parties have intensified, jeopardizing peace," Fan said.

Choe responded by saying peace could not be assured although North Korea wanted it in order to build the country, and it was willing to work with all sides in solving problems.

"The situation on the Korean peninsula and in Northeast Asia is complex and extraordinary, and there is no guarantee of peace," Xinhua cited Choe as saying.

"The North Korean people need a peaceful and stable environment to build their country," Choe was quoted as saying. "The North Korean side wishes to work together with all parties and, through dialog, seek a means to resolve the problem."

On Thursday, Choe told another senior Chinese official that North Korea was willing to return to talks, although the prospect for those in the near future is dim.

Tension has been mounting between North Korea and China even though China is the North's most important economic and political backer.

Ties have been hurt between the two supposed allies by the North's third nuclear test in February, despite China's disapproval, and by China agreeing to U.N. sanctions on the North in response and starting to put a squeeze on North Korean banks.
