PST: Is David Beckham headed to China?

Transparent journalistic sourcing out of the English press being what it is ? or more accurately, being what it usually is not ? we must always file player movement stories somewhere between ?accurate information? and ?throwing spitballs to see if something sticks.?

One of today?s big talkers out of England says David Beckham is in talks to finish his illustrious playing days in China. That is according to this story in the Daily Mail.

If it?s true, he would join fellow EPL-exers Didier Drogba and Nicolas Anelka, both of whom have recently been drawn by the lure of big stacks of cash to Shanghai Shenhua. Beckham, of course, doesn?t need the green. Rather, it would be about expanding Brand Beckham and all that it implies.

What an unnamed source told The Daily Mail:

He has cracked Europe and America, he now has the chance to become huge in China and the Far East. This is a huge decision for him. While David wants one final challenge in football, a move to China is about more than that. It will push Brand Beckham to a whole new level.?

So this does deserve watching, if only because most of the important news related to Beckham has always come out of England, where his management handlers are based. That was true even for all the years Beckham has been based out of Los Angeles.

Track poor behavior even after improvement ? Business ...

Some employees will permanently per??form and behave better if they believe their jobs are at stake. But for others, the improvement is only temporary.

That?s why it is important to track performance and behavior over time. You can still use the earlier problems as partial justification for termination.

Recent case: Carol had a propen??sity to inappropriate outbursts. She was placed on a performance im??provement plan and did improve?temporarily. Then she backslid, asking her supervisor whether she had ?stopped taking? her medication.

She was fired and sued, alleging age discrimination. Carol?s employer said she was fired for years of poor behavior, including insubordination be??fore and after being warned to improve.

The court dismissed the case, con??cluding the employer was free to use old and new incidents to support the decision. (Rubinow v. BIP, No. 11-2879, 2nd Cir., 2012)

LLC?s, Corporations, And Other Business Structures - Part III: Written By New York Entertainment Lawyer And LLC Counsel John J. Tormey III, Esq.

? John J. Tormey III, PLLC. All Rights Reserved.

This article is not intended to, and does not constitute, legal advice with respect to your particular situation and fact pattern. Do secure counsel promptly, if you see any legal issue looming on the horizon which may affect your career or your rights. What applies in one context, may not apply to the next one. Make sure that you seek individualized legal advice as to any important matter pertaining to your career or your rights generally.

Part II of this article discussed how individuals historically incorporated their businesses in the hopes of avoiding personal liability, but then often became dissatisfied with the so-called ?double taxation? thereby resulting. This, among other motivations, brought the S-corporation and then, the limited liability company (LLC), into being. As a New York entertainment lawyer practicing in this day and age, I most often see limited liability companies (LLC?s) as opposed to other forms of entities used in film, music, television, publishing, and Internet businesses. However one cannot understand and appreciate the advantages typically provided by the limited liability company (LLC) unless superimposed as bas-relief upon the entity?s historical context ? which gives further meaning to the LLC across all sectors and industries including entertainment and media.

Society clearly benefits from encouraging people to start businesses - and take some commercial risks without an attendant risk of personal ruin. Yet otherwise well-intentioned and well-motivated people were either quitting businesses or exposing themselves to personal liability - in both instances due to their aversion to the so-called ?double layer of taxation? engendered by the C-corp. Additionally, the ?double? taxation of the C-corp was creating a disincentive for new people to go into business - particularly those who were risk-averse. There had to be a better way.

That better way, at the time, was the S-corp, which came into existence a number of years ago principally for the above types of reasons and rationales. It was named after a ?Subchapter-S? in the Internal Revenue Code of the United States, and was regularly recognized by the IRS and state tax authorities alike. One of the familiar tasks for an entertainment lawyer became the act of ensuring that clients timely made their appropriate S-corp elections (see below) with appropriate governmental authorities ? hardly the romantic notion one would have of what it is like to interact with talent and go to celebrity premieres..

Akin to the C-corp in most other respects, the S-corp only mandated a single layer of taxation, as opposed to the C-corp?s double layer of taxation. But there were also a few catches.

One had to make a formal written ?election? (or in some cases, ?elections?) to qualify as an S-corp. If one didn?t do so in time by a strict deadline, one would lose S-corp status and be ?doubly? taxed like a C-corp instead. As most entertainment lawyers can attest, this kind of eventuality could actually snuff out a fledgling entertainment or media start-up business in its first years of existence, already engaging in risky and speculative business activity as is often the case in media and entertainment.

There were other restrictions on S-corps, too, such as a limit on the number of shareholders, a limit on foreign ownership, and a limit on corporate parent-subsidiary ownership. Some of these restrictions have been loosened - and in some cases eliminated - in recent years; so one should not rule out the S-corp without first updating its tax code requirements with one?s lawyer ? entertainment lawyer or otherwise ? as well as one?s tax accountant. The historical restrictions of the S-corp put business owners in a ?Catch-22? situation - they clearly wanted a single layer of taxation, but in the context of an entity that wasn?t so restricted. The newer solution: scrap the idea of a corporation at all, and instead form a limited liability company, or LLC.

The limited liability company (LLC) is akin to the S-corp but without most of the attendant historical restrictions. Yes, there were a certain number of restrictions on the LLC, too, when it first appeared on the scene - most of which were subsequently lifted by either the IRS or state legislatures, or both. Again, S-corp restrictions have also been lifted in recent years, making the S-corp and limited liability company (LLC) look more similar to each other as time goes on.

But even as of this writing, the limited liability company (LLC) is usually considered the most advantageous entity from a tax perspective of all 3 most commonly available forms, for the small business owner to create. As a media and entertainment lawyer, the LLC is the entity which I am most often asked to create. The LLC is also considered the most flexible of all 3 entities. What does ?flexible? mean? Well, it is considered easier to adapt the LLC to later-occurring additional equity-holders in one?s business, for example, which is another familiar task for an entertainment lawyer in the context of artistic co-ventures - and the word ?easier? in this context translates to ?less legal fees?. The LLC is in most cases an entity which is easier to manage and administrate.

There are some disadvantages to the limited liability company (LLC), too. The LLC can take more time to finalize, and in some cases can be more expensive to form and/or file with the government - as compared to an S-corp. Some states historically prohibited 1-person LLC?s. Some states still have an underdeveloped body of judicial case law on the LLC, since the entity is still quite new in many states - so the treatment of the LLC under the law may be less certain than the treatment of a corporation. We in New York have an odd restriction, too, as a result of the powerful newspaper and media lobby galvanized during the legislation?s enactment which as a media and entertainment lawyer I suppose that I should not begrudge. This restriction may be present in another state or two as well in analogous form. The restriction is this: if one elects to form a New York LLC, one must publish its existence in periodicals for a number of weeks, before being accorded the legal privilege of initiating a litigation - as a plaintiff - in the LLC?s name in the New York courts. Publication of an LLC?s naissance in Manhattan is expensive - the publication of a limited liability company in periodicals of the creation of a proposed Manhattan LLC can range between $1,000 and $3,000 (the figures can vary and are smaller in other parts of New York State apart from Manhattan).

Even so, the limited liability company (LLC) is considered the trend-setting entity of those ?in the know?, across the country. As an entertainment lawyer in New York, I have noticed that hipster Californians gravitate to LLC?s just as much as hipster New Yorkers seem to do. And part from hype, assuming that one can afford to form an LLC, and assuming that one can live with whatever restrictions apply to the LLC in one?s jurisdiction, it may in fact be the entity of choice, and an improvement over the older S-corp and C-corp structures.

A limited liability company (LLC), though frequently mistaken for a corporation, is technically not considered a corporation ? rather, it is an unincorporated entity under the tax code, more like a partnership than anything else, but one that (like the S-corp and C-corp), if properly formed and maintained, should provide its members with insulation against personal liability.

If one doesn?t incorporate or form a limited liability company (LLC), the business will likely be what is known as either a sole proprietorship (if a 1-person company), or a general partnership, de facto or otherwise, (if comprised of 2 or more persons). Any entertainment lawyer or other lawyer will opine that this could result in unlimited personal liability for the entity?s owner or owners. Again, that means that an owner?s personal assets can be at risk to satisfy the obligations and debts of the business. Any entertainment lawyer or other lawyer will opine that personal liability is not a risk worth taking. In addition, using a corporate entity or limited liability company (LLC) ? particularly an LLC in this day and age - could add a good deal of ?cachet? or credibility to one?s business endeavors, in the eyes of other persons and companies with whom the business has contact.

Prostate cancer: The top treatment advances in 2012

Advances in prostate cancer treatment probably won?t make most Americans? list of top 2012 events, but for some men, and their families, such developments stand out among the year?s medical news.

    Slide of prostate cancer

Two FDA approvals topped the list of advances in treatment of prostate cancer (shown here via slide) during 2012, one City of Hope expert says.

Cy Stein, M.D., Ph.D., deputy director for clinical research, holds up two 2012 events as being particularly significant in the treatment of prostate cancer. One was? the FDA approval of the drug enzalutamide (Xtandi) for the treatment of men previously treated with the chemotherapy drug taxotere (Docetaxel) .

?This is an excellent drug that works, in summary, by blocking the interaction of testosterone, the male sex hormone, with the androgen receptor, which drives the growth and metastasis of prostate cancer cell,? says Stein, the Arthur and Rosalie Kaplan chair and professor of the Department of Medical Oncology and Therapeutics Research. ?Enzalutamide has been shown to prolong median life expectancy by approximately 5 months, and is very well-tolerated by most patients.??

A better pencil sharpener? Inventor dreams of erasing life's annoyances

    6 hrs.

Long lines at amusement parks. Traffic stalled at rush hour. Cycling uphill. To most of us, these are just minor problems we face in an otherwise comfortable existence.?To Anwar Farooq, they are personal call-outs, challenges that he must answer with his own ingenuity. These days, the math?teacher and habitual?inventor is wrestling with the age-old problem of the?pencil sharpener.

"When I saw my students struggling with the regular pencil sharpener, I honestly knew that there must be an alternate approach, so I started thinking," Farooq, who teaches?at Maywood Academy,?southeast of Los Angeles, told NBC News.

That's not the first time Farooq "started thinking."

His inventions, spanning 1986 to now, may?seem whimsical at first, but on closer inspection are like early ancestors of devices in use today. There's a bike where your pedaling is boosted by an air compressor, for instance. If you replace the air compressor with an electric motor, you get today's battery-powered bikes.

There's?the Robocam, a?remote-controlled camera platform that's a precursor to telepresence robots and smartphone?videoconferencing apps alike.

For those annoying amusement park or movie theater?lines, Farooq proposes a chain of connected, moving chairs.?You take a load off, enjoy the?built-in entertainment system, and before long, it's your turn to get up and enjoy the ride or show. He calls it Waiting Is Fun.?It may seem far-fetched?... until Disney goes and installs one in Tomorrowland.

The idea Farooq seems most proud of is the?Rapid Commute. Cars traveling from the outskirts of a city?drive right onto a high-speed train, as if they were boarding a ferry boat. The train then brings them to a central location downtown, where they disembark. Next month he will be presenting it to the Transportation Research Board, an off-shoot of the non-profit?National Research Council,?at its annual meeting in Washington, D.C.

And then there's the?Quick N Silent pencil sharpener.?

    * * *

Pencil sharpeners are, in fact, one of the few classroom technologies that have?not?experienced a radical redesign in the past century. The most common type of institutional sharpener, the hand-cranked type you can still see?mounted to a wall or the teacher's table in classrooms all over the world,?was introduced in 1904.

Sure, electric versions have been introduced, but?the cylindrical mills rotating in "planetary" fashion within?are still dominant ? despite the inconsistency of their results.

Nevertheless, when Farooq wrestled with how to modernize the?pencil sharpener, he didn't look to some?laser that could hone the tip of a pencil with micron-level precision. Instead, he found inspiration in the distant?past.

"I remembered that people carried pocket knives and they just used those to sharpen pencils quietly and efficiently."

He set to work on the new machine based on the same principles.

    * * *

Farooq was always an inventor at heart, but he told us that, growing up in Pakistan, he never had a chance to exercise his creative capabilities. "Even if I had an idea, we were from the lower middle class, so we didn't have any money to do anything," he told us. "My biggest break is that I came to a country like America ??and now I can do those things I desire."

But even after moving to the U.S. in the 1970s, inventing hasn't been exactly easy for Farooq. In fact, following his dreams can at times be something of an expensive habit. "Of course it's a hardship to me and tight financially," he admitted. "My wife says, 'Why don't you take up gambling?'"

At least to him, though, the cost is worth it.?"I live for that, that excitement of finding something, of discovering something." He points out that the famed inventor Nicola Tesla died a poor man, but now they're building a Tesla?museum. Farooq doesn't expect a museum, but he does hope that his inventions will outlast him.

It may be his latest baby, the pencil sharpener,?that lives on. Even in our increasingly?digital world, Farooq feels strongly that pencil and paper, as?a medium for recording thoughts and images, won't disappear any time soon.?"Yes, it is old and unglamorous technology, but it's foolproof and works as advertised."

Its biggest asset is its low cost: "It's cheap enough to be owned by almost anyone in the world," he said.

When he finally figured out how to implement the pocket-knife method of sharpening, Farooq built a mock-up and?patented his design.

His prototype doesn't grind, like the rotary sharpeners in classrooms?worldwide. Nor does it shave around the edge, like the small twisty?single-blade sharpeners that predate the rotary type. Instead, it uses multiple blades to whittle down the edge from all sides at once. True to its name, the blades slice down the end of the pencil, exposing a sharp tip and plenty of lead in a single, silent pass.

Farooq is looking for funding to start manufacturing the device, which he has continually modified over the last few years in his spare time.?A crowd-funding attempt at?Fundageek, a website for inventors, has not produced much income. But he intends to put a more complete version of the device up for consideration on Indiegogo, a larger platform for collecting funding.

In the meantime, Farooq will keep on inventing. His own modest?website lists two things ? Personal Safety 360 and GPS Live Cam ??that he isn't ready to discuss publicly.

"When I came to this country,?I wanted to do something positive, a legacy to leave behind." Whether his inventions find widespread adoption or not, Farooq's insatiable inventor's spirit may continue to inspire the kids in his classroom ??as well as those who encounter him through his growing portfolio.

Stocks down as U.S. aims to avoid "fiscal cliff"

NEW YORK (Reuters) - World stocks and the euro slipped on Friday while U.S. shares fell for a fifth day as the White House and U.S. lawmakers planned to make a late effort to avoid the U.S. "fiscal cliff."

Meanwhile, expectations that Japan will inject new stimulus into its economy pushed the yen to a two-year low for a third straight day.

President Barack Obama and Democratic and Republican lawmakers were scheduled to meet on Friday afternoon as the deadline looms for reaching a budget deal to avert massive tax increases and spending cuts that could drag the economy - and others around the world with it - into recession.

Participants in the 3 p.m. session (2000 GMT) will attempt to smooth over sharp differences on raising taxes on higher-income Americans and spending cuts in politically sensitive social welfare programs such as Medicare and Medicaid.

The MSCI all-world share index <.miwd00000pus> was down 0.2 percent and the pan-European FTSEurofirst 300 <.fteu3> ended down 0.6 percent.

In U.S. trading, the Dow Jones industrial average <.dji> was down 69.42 points, or 0.53 percent, at 13,026.89. The Standard & Poor's 500 Index <.spx> was down 6.77 points, or 0.48 percent, at 1,411.33. The Nasdaq Composite Index <.ixic> was down 8.42 points, or 0.28 percent, at 2,977.48.

Allowing $600 billion of higher taxes and spending cuts to start in January would prevent U.S. debt spilling beyond a $16.4 trillion agreed limit. However, analysts fear the measures could wipe as much as 4 percent off the country's growth rate.

"The recent market movement is all about the lack of resolution and clarity on the 'cliff' and comes despite the fact that most economic reports have been very favorable," said Richard Weiss, a Mountain View, California-based senior money manager at American Century Investments. "We have to believe, once Congress comes to any resolution - whether it comes before the New Year or after - the market will resume its upward trend, as data indicates it should."

Among Wall Street's gains, Barnes & Noble Inc rose 6.4 percent to $15.27 after the company said Pearson had agreed to make a strategic investment in its Nook Media subsidiary. However, it said the Nook business will not meet the bookseller's prior projection for fiscal year 2013.

    EURO FALLS, YEN HITS LOW

The euro was down 0.1 percent on the day at $1.3221, having slipped to a session low of $1.3164. Traders said it broke below stop-loss sell orders around $1.3170.

An agreement on the U.S. budget would be viewed as positive for riskier currencies such as the euro and Australian dollar, while a deadlock or snags in the negotiations would be deemed positive for the safe-haven and highly liquid dollar.

"Speculative market participants are not very happy with these levels and look at it as a good opportunity to sell the euro, which is leading to the rapid drop in euro/dollar," said Ulrich Leuchtmann, head of FX research at Commerzbank.

The yen's unabated slide since Shinzo Abe took the helm as Japan's prime minister on Wednesday has taken the currency to two-year lows for three straight days. Abe has vowed to press for aggressive monetary stimulus to fight deflation.

The dollar was steady against the yen at 86.11 yen, edging away from a peak of 86.64 yen, its strongest since August 2010, when it stopped just shy of reported options barriers at 86.75 yen and 87.00 yen.

In the U.S. bond market, benchmark Treasuries yields dropped to their lowest levels in two weeks as concerns that the economy would be harmed by tax hikes and spending cuts and a fall in consumer confidence spurred demand for safe-haven bonds.

Benchmark 10-year notes were last up 4/32 in price, with yields falling to 1.72 percent, down from 1.73 percent on Thursday and from a two-month high of 1.85 percent a week and a half ago.

    BRENT OIL EASES

Brent crude oil held below $111 per barrel, not far off its highest this month.

Brent crude was down 59 cents to $110.21, on course for a weekly gain of about 1.5 percent and a full-year increase of about 3 percent, which would be the smallest in four years.

U.S. crude was down 19 cents to $90.67 and was set for its first yearly loss in four years.

In other commodity markets, U.S. gold for February eased $2.00 an ounce to $1,661.70.

Despite the tensions over the U.S. budget talks, the mood in financial markets has been improving in recent weeks. Data from emerging economies has shown signs of a pick-up while analysts are hopeful that Europe may also soon bottom out.

A Reuters poll showed economists think China's factory activity probably expanded at its fastest pace in eight months in December.

(AP) ? Dockworkers along the East Coast and the Gulf of Mexico agreed Friday to extend their contract for more than a month, averting a weekend strike that could have crippled major ports from Boston to Houston and bottled up billions of dollars' worth of cargo.

Talks aimed at reaching a new contract covering the 14,500 longshoremen will continue during the extension, which runs through Feb. 6.

The dockworkers' union and an alliance of port operators and shipping lines agreed to the extension after resolving one of the stickier points in their negotiations, involving royalty payments to longshoremen for each container they unload. Details were not disclosed.

Federal mediator George Cohen said the agreement on royalties was "a major positive step forward."

"While some significant issues remain in contention, I am cautiously optimistic that they can be resolved," he said.

The contract between the International Longshoremen's Association and the U.S. Maritime Alliance originally expired in September. The two sides agreed to extend it once before, for 90 days, but it had been set to expire again at 12:01 a.m. Sunday.

As recently as Dec. 19, the president of the longshoremen's union, Harold Daggett, had said a strike was expected.

A walkout would have crippled the loading and unloading of a vast number of products, including electronics and clothing, and made it more difficult for U.S. manufacturers to get parts and raw materials at a time when the economy is in shaky condition. The ports involved handle about 40 percent of all U.S. container cargo.

Business groups expressed relief that the two sides had agreed to keep the docks running.

"A coast-wide port shutdown is not an option. It would have severe economic ramifications for the local, national and even global economies and wreak havoc on the supply chain," said National Retail Federation President Matthew Shay.

White House spokesman Matt Lehrich said: "We're pleased the parties are going to continue their work at the negotiating table and continue to urge them to reach an agreement as quickly as possible."

Major ports that would have been frozen included the massive terminals serving the New York City area and critical seaports in Savannah, Ga., Houston, and Hampton Roads, Va.

Other ports that would have been affected are in Boston; the Philadelphia area; Baltimore; Wilmington, N.C.; Charleston, S.C.; Jacksonville, Fla.; Fort Lauderdale, Fla.; Miami; Tampa, Fla.; Mobile, Ala.; and New Orleans.

Longshoremen on the West Coast have a separate contract.

Total Recall: Quentin Tarantino's Best Movies

We count down the best-reviewed work of the Django Unchained director.

    Brad Pitt

Since making his debut with Reservoir Dogs 20 years ago, Quentin Tarantino has enjoyed one of the fastest-rising -- and consistently critically lauded -- careers of any director in modern Hollywood. He's back this weekend with the Jamie Foxx-led revenge fantasy Western Django Unchained, and the reviews are typically solid -- which means now is the perfect time to dedicate a feature to taking a fond look back at his earlier efforts. So cover the kids' ears and keep an eye on Marvin in the back seat, because this week, we're serving up Total Recall Tarantino style!

    14%

The appeal of anthology films -- that audiences can see the work of multiple directors under one narrative umbrella -- can also be one of their major drawbacks: The results, as in 1995's Four Rooms, often strike some viewers as wildly, painfully uneven. As this particular outing proved, success isn't guaranteed even if you bring together a handful of the industry's most critically beloved and/or commercially ascendant filmmakers; although Four Rooms united Tarantino, Robert Rodriguez, Allison Anders, and Alexandre Rockwell to tell the promise-rich tale of a beleaguered bellhop (Tim Roth) making his way through a series of progressively weirder hotel rooms on New Year's Eve, only Rodriguez's segment escaped heaps of withering critical scorn, and the film barely eked out $4 million at the box office. But a 14 percent Tomatometer rating means that a few critics liked it -- such as Boxoffice Magazine's Shlomo Schwartzberg, who shrugged and said, "As a whole, Four Rooms is only diverting, and pretty mindless, but at its best it's a lot of fun."

    83%

Forged by the bond of friendship between Tarantino and Robert Rodriguez -- as well as their shared love of sloppy, bloody, low-budget exploitation flicks -- 2007's Grindhouse found the two directors splitting a three-hour double bill that took audiences from cheeky zombie terror (Rodriguez's Planet Terror) to seethingly violent high-octane action (Tarantino's Death Proof). At 65 percent, Tarantino's half of Grindhouse got the short end of the Tomatometer stick, but plenty of critics still enjoyed his gleefully depraved look at a homicidal stuntman (Kurt Russell) with a fondness for murdering young ladies. "I've rarely seen a filmmaker, in current Hollywood at least, expose his sexual and sadistic kinks on screen with such shameless glee," observed an admiring Kevin N. Laforest for the Montreal Film Journal.

    84%

Six months after kicking off his Kill Bill revenge saga with Volume 1, Tarantino returned to theaters with its conclusion. Part kung fu brawl, part origin story, Kill Bill: Volume 2 fills in the blanks of its katana-wielding protagonist's (Uma Thurman) past while she slices and dices her way to whatever passes for redemption. Clocking in at over four hours between the two installments, it's a pretty hefty cinematic experience for something that boils down to a fairly simple tale, but most critics didn't mind at all -- in fact, Volume 2 performed nearly as well as its predecessor on the Tomatometer. As Jeremy Heilman of MovieMartyr argued, "The massive combination of the first and second Kill Bill movies stands as a testament to both Tarantino's exceptional skill as a filmmaker and the possibilities of pop cinema."

    85%

After an interminable-seeming six-year wait following Jackie Brown, Tarantino re-emerged with a blood-spattered martial arts epic so sprawling it needed to be chopped in half. Enter 2003's Kill Bill: Volume 1, starring Uma Thurman as an assassin whose plans to leave the fold for a life of wedded bliss hit a snag when her mentor (David Carradine) decides he'd rather have her dead than retired, and sends her fellow killers-for-hire (played by Lucy Liu, Vivica A. Fox, Daryl Hannah, and Michael Madsen) to put a permanent stop to the nuptials. After watching Thurman's take-no-prisoners performance, the New York Observer's Andrew Sarris couldn't help but say, "I would argue that, in a bizarre way, Mr. Tarantino empowers women as no action-genre director before him ever has."

Two Sub-$10 Stocks That Could Graduate To Double-Digits | Stocks ...

Editor's Note: This content was originally published on Benzinga.com by Gordon Wilcox.

Revisiting the theme that price alone is not the true determinant of a stock's total value is a task worth repeating from time-to-time, even more so when investors find themselves seduced by the temptation of volatile single-digit stocks.

The temptation is easy to understand. After all, $10,000 in capital buys a lot more shares of an $8 stock than an $80 stock. Of course, it is this conventional way of thinking that has plagued so many investors in the past when it comes to single-digit stocks.

Still, not all single-digit stocks are afflicted with that condition forever. Many have the potential to graduate to $10 and beyond. Here are some candidates to make that move in 2013, though in a couple of examples while $10 may be a real possibility, how long the stock stays there is up for debate.

Alpha Natural Resources (NYSE:ANR): Like many coal stocks, Alpha Natural spent the bulk of 2012 plunging. With just a few trading days left in the year, the stock is down 54.5%. The primary catalyst behind Alpha Natural's 2012 woes has been thermal coal demand or lack thereof. Thermal coal is the coal variety used by electric utilities, but with natural gas prices depressed, utilities have turned to cheaper, cleaner gas as an alternative.

Slack thermal coal demand prompted Alpha Natural to announce?significant production reductions?in the third quarter. Investors may remember that Alpha Natural acquired Massey Energy to increase its exposure to metallurgical coal, the coal grade used in the the production of steel.

That move has not worked out so well, at least not yet, because metallurgical coal demand by emerging markets consumers has waned, forcing prices lower. Weak metallurgical coal demand is also one reason why?Standard & Poor's recently lowered Alpha Natural's credit rating?to BB- from B+. That downgrade takes the company deeper into junk territory.

All of this may imply that Alpha Natural is a stock to stay away from. However, the shares have jumped 29.4% in the past month. Additionally, Alpha Natural is positioned to take advantage of any significant increase in natural gas prices because that would force utilities back to thermal coal. Or the Chinese and Indian economies could rebound enough to jolt metallurgical coal prices. With a beta of 1.68 and the shares flirting with $9.30, Alpha Natural could easily hit $10 in the near-term. Bullish economic data points out of China could carry the stock even higher.

SpaceX rocket goes for 12-story-high hop

A SpaceX video shows the Grasshopper prototype rocket taking a 12-story leap toward full rocket reusability in a Dec. 17 test flight.

    By Alan Boyle

SpaceX's prototype Grasshopper rocket took one giant leap last week, rising to a 12-story height and settling back down safely on its landing legs at the company's Texas rocket test facility. Just for fun, the engineers let a dummy cowboy go along for the ride.

The Dec. 17 test flight at the pad in McGregor, Texas, was documented in a YouTube video released today ? and discussed in a?series of lighthearted tweets from SpaceX's billionaire founder, Elon Musk.

"To provide a little perspective on the size of Grasshopper, we added a 6-ft cowboy to the rocket. ... Then we took him for a ride," Musk wrote. So how did the cowboy fare? "No problemo," said Musk.

The 10-story-tall Grasshopper rocket is designed to take off and land vertically, as part of Musk's plan to develop a rocket capable of returning itself to a launch pad for rapid reusability. Today's vertical-takeoff launch systems generally rely upon expendable lower stages ? although the space shuttle's solid rocket boosters could be recovered from the Atlantic Ocean and refurbished for reuse. If a rocket stage can return to its launch facility intact and ready to go again, that could significantly lower the cost of spaceflight. That's what Musk is shooting for.

SpaceX says the Grasshopper consists of a Falcon 9 rocket first stage, a Merlin 1D engine, four steel landing legs with hydraulic dampers, and a steel support structure. During the prototype's first flight test on Sept. 21, the Grasshopper rose 6 feet into the air. The second test, on Nov. 1, lasted 8 seconds and lifted the Grasshopper 17.7 feet (5.4 meters) off the pad.?The company said last week's third test went for 29 seconds, during which the Grasshopper rose 131 feet (40 meters) into the air, hovered and landed safely back on the pad, using closed-loop thrust vector and throttle control.

    SpaceX

A dummy cowboy is perched on SpaceX's Grasshopper rocket for a Dec. 17 test.

In addition to the Grasshopper, SpaceX is sending its Dragon capsules to resupply the International Space Station, working on a version of the Dragon that could carry astronauts into orbit sometime soon, and developing a Falcon Heavy rocket that could conceivably power flights to the moon. But Musk's long-range goal is even more ambitious: getting settlers to Mars. He has said Grasshopper-style rocket reusability is a key part of that long-term strategy.

"If it does works, it'll be pretty huge," he said last year during a speech at the National Press Club in Washington. ?

Iraqi telecom Asiacell hopes to raise $1.3 billion

(AP) ? Asiacell, one of Iraq's three mobile service providers, said Tuesday it is looking to raise $1.3 billion through what would be the country's biggest stock offering yet.

A successful floatation on Baghdad's low-volume stock exchange could reassure international investors, many of whom remain wary of the risky Iraqi market nearly a decade after the U.S.-led invasion in 2003.

The company plans to offer 67.5 billion shares for at least 22 Iraqi dinars, or just under 2 cents, apiece when it launches the initial public offering on Jan. 3. Investors will have until Feb. 2 to submit orders for the shares.

"We're delighted to be able to provide the chance for all Iraqis to participate in our future by taking a stake in Asiacell," Managing Director Faruk Rasool said in a statement. "We're confident in our future as Iraq's mobile industry continues to grow."

The shares being offered represent a quarter of Asiacell's total share capital. The Gulf state of Qatar's government-backed Qatar Telecom owns 53.9 percent of Asiacell, which is based in the northern Iraqi Kurdish city of Sulaimaniyah.

A number of the company's founding shareholders will be cashing out at least part of their investment with the floatation.

Asiacell competes against Zain Iraq, part of Kuwait's Zain, and Korek, an affiliate of France Telecom.

The three companies are required to list shares on the stock exchange as a condition of their 15-year operating licenses, which cost $1.25 billion when they were acquired in 2007. All three missed a deadline in August 2011 to offer shares to the public.

Asiacell began offering cell phone service in Iraq's highly autonomous northern Kurdish region in 1999. Mobile phone services did not exist in the rest of Iraq until after the 2003 U.S.-led invasion that toppled the dictatorship of Saddam Hussein.

The company now boasts nearly 10 million subscribers and says its network covers 97 percent of Iraq's population.

Tips For Successfully Marketing Your Internet Business - Maynas Eric

How do you feel about website marketing? Do you research ways to improve your business promotion, then implement them? There are a ton of great tools out there to help you learn more about website marketing, like books, videos, magazine articles, web posts and more. You need to set up plans and goals. Read these tips and see if they lead you to a good starting point.

One way to boost the PageRank for your online commerce site is to offer a limited-time promotion. If the deal is good enough, you can ?buy? PageRank because consumer news and deals sites will link to yours. This is the same concept as a company selling an item at a loss, with the expectation that it will turn into a profitable situation at a later time.

Explore existing research about the psychological and emotional connections that people associate with certain webpages and online marketing communications. There are factors of a psychological nature that impact how your brand is perceived by a customer. Some of these factors are layout, color and theme. Understanding these suggestions is critical to optimizing your company?s operations.

TIP! To make your online advertisements more effective, make use of words like ?limited? and ?special?. People like to own things that are not commonly available.

It is common knowledge that an authority position in a business generates respect. Let others know that you hold a ranked position within your company. You can refer to yourself as the ?President? or ?CEO? of your company.

Always back up what you say in your ads with concrete examples. It?s common for people to not trust advertising copy. There are a wide array of supporting tools you can use to back up your claims and improve customer confidence, including guarantees, references, testimonials and studies. When you are dropping unproven statements throughout your site, people will ignore and dismiss you and your site.

Study your competitors and choose the best of their sales and advertising tactics to enhance your own. If you see yourself as a potential customer for their products, then they are doing something right. You should find a way to incorporate these ideas into your strategy.

TIP! Give visitors to your website a service or some type of product for free. Many will visit for the free offer.

By offering to donate a portion of your profits to charity you can generate interest, trust and, ultimately, sales. Most people like to help those in need, so this can be a good sales strategy that creates a win-win situation. You should make sure to clearly advertise this without being excessive. Even a small donation can increase your sales, as people like to know their money is going to a good cause.

Give your customers the chance to sign up to your Ezine.
